Brewers’ property liable to confiscation: who, what and why? (2015-01-13)

According to the request from representatives of the brewing industry to the Union to clarify details and confiscation procedure, we note as follows:

30.12.2014 the Committee of the Federation Council approved the bill drafted by the Federal Service for Alcohol Market Regulation in order to fight illegal alcohol trade. The law came into force in January 1, 2015.

The Law touches upon beer partially (as beer has not been licensed yet).

According to the law the following items are liable to confiscation:  

production non-complying with the state standards and technical requirements;

– production without corresponding documents approving legality of manufacturing and circulation of alcohol products;

– after introduction of the Unified State Automated Information System, products, not fixed in this system, are liable to confiscation;

– the core technological equipment, being in the ownership and in operational control of the company and is located in the industrial space.

Illegal alcohol and raw materials must be wasted, equipment shall be removed, dismantled, kept outside the territory of the company and transport – sold. Means received, will be arrived in the account of the department, fixing the breach. All these procedures will be controlled by the Government. Besides, samples of alcohol, raw materials and containers shall be kept till the judgment of the administrative violation come into force.
