New requirements of the Federal Service for Alcohol Market Regulation to the marking of alcohol products, containing less than 7% of alcohol – public discussion (2013-10-28)

We’d like to inform you of preparing a draft of the Federal Regulatory Legal Act «Concerning the Introduction of an Amendment to Article 11 of the Federal Law “On the State Regulation of the Production and Circulation of Ethyl Alcohol, Alcoholic and Alcohol-Containing Products and limits for alcohol consumption”».

This draft bill is focused on resolving legal uncertainties in the question of informing consumers of harmful substance in the alcohol products compared to GOST essential requirements and contraindications to use such products; ethanol content in the alcohol products, ethyl alcohol content no more than 7% of the total output in 100 mil of this production and in the volume of consumption package; contraindications for alcohol consumption.

According to the draft bill the responsibility in point of informing consumers of harmful substance in the alcohol products compared to GOST essential requirements and contraindications to use such products, ethanol content in the alcohol products, ethyl alcohol content no more than 7% of the total output in 100 mil of this production and in the volume of consumption package, contraindications for alcohol consumption is planning to devolve on authorized Government executive bodies. At present time the alcohol products retailing in the territory of the RF are provided with GOST information Р 51074-2003 “Information for a consumer. General requirements”. Information requirements mentioned in the point 3 of the Article 11 of the Federal Law No 171-FZ as of November 22, 1995 “Concerning the State Regulation of the Production and Circulation of Ethyl Alcohol, Alcoholic and Alcohol-Containing Products and limits for alcohol consumption” (hereinafter referred to as the Federal Law No 171-FZ), as now or hereafter in effect are executed by economic entities from January 1, 2012. Technical Regulations of the Customs Union No 881 “Food production in so far as it relates to marking” confirmed by the decision of the Union Commission from December 9, 2011 became operative on 1st of July 2013.

Also the Federal Service for Alcohol Market Regulation created the Technical Regulations of the Customs Union “On Alcohol Production Safety”, including the requirements for alcohol marking.
